Welcome to Fresh Home Contracting. These Terms of Service ("Terms") govern your use of our website and services. By engaging with our services or accessing our website, you agree to be bound by these Terms. Please read them carefully.
Fresh Home Contracting ("we," "us," or "our") provides home renovation and contracting services throughout Central Ohio. These Terms apply to all clients, visitors, and users of our services.
Fresh Home Contracting offers a variety of home renovation and contracting services, including but not limited to:
All services are subject to availability, proper licensing, and compliance with local building codes and regulations.
3.1 Free Estimates: We provide free estimates for our services. Estimates are based on information provided by the client and preliminary assessments. Final pricing may vary based on actual conditions discovered during the project.
3.2 Written Quotes: All formal quotes will be provided in writing and are valid for 30 days from the date of issue unless otherwise specified. Quotes are based on the scope of work outlined and current material costs.
3.3 Quote Acceptance: A quote becomes a binding contract when signed by both parties and accompanied by any required deposit payment.
4.1 Deposit: A deposit is typically required before work begins. The deposit amount will be specified in your written quote or contract.
4.2 Progress Payments: For larger projects, payment may be divided into milestone-based progress payments. Payment schedule will be outlined in the contract.
4.3 Final Payment: Final payment is due upon project completion and client approval. We accept cash, check, credit cards, and electronic payments.
4.4 Late Payments: Late payments may be subject to interest charges as permitted by Ohio law. Work may be suspended if payments are not received according to the agreed schedule.
5.1 Estimated Completion: We provide estimated project completion dates in good faith. While we strive to meet all deadlines, timelines are estimates and may be affected by factors beyond our control.
5.2 Delays: Potential causes of delays include but are not limited to: weather conditions, material availability, unforeseen structural issues, permit processing delays, and changes to the scope of work. We will communicate any anticipated delays promptly.
5.3 Client Responsibility: Clients are responsible for timely decisions on material selections, design approvals, and access to the work site. Delays caused by client decisions may extend the project timeline.
6.1 Change Orders: Any changes to the original scope of work must be documented in writing through a change order. Change orders may affect project cost and timeline.
6.2 Additional Work: Additional work discovered during the project (such as structural issues, code violations, or hidden damage) will require client approval before proceeding. Such work will be billed separately.
6.3 Approval Process: All change orders must be signed by the client before work proceeds. Verbal agreements for changes are not binding unless confirmed in writing.
7.1 Workmanship Warranty: We warranty our workmanship for a period specified in your contract (typically one year from project completion). This warranty covers defects in our work but does not cover normal wear and tear or damage caused by misuse.
7.2 Material Warranties: Materials are covered by manufacturer warranties. We will assist in warranty claims but are not responsible for manufacturer defects or warranty fulfillment.
7.3 Warranty Claims: Warranty claims must be reported in writing within 30 days of discovering the issue. We will assess and address valid warranty claims in a timely manner.
8.1 Insurance Coverage: Fresh Home Contracting maintains general liability insurance and workers' compensation insurance as required by Ohio law. Proof of insurance is available upon request.
8.2 Client Responsibility: Clients are responsible for ensuring valuable or fragile items are removed from work areas. We are not liable for damage to items not removed from the work area.
8.3 Limitation of Liability: Our liability is limited to the contract value of the specific project. We are not liable for indirect, consequential, or incidental damages.
9.1 Client Cancellation: Clients may cancel a project by providing written notice. Cancellation fees may apply for work completed, materials purchased, and administrative costs incurred.
9.2 Our Right to Terminate: We reserve the right to terminate a contract if: payment terms are not met, the client fails to provide necessary access or approvals, or circumstances make it impossible or unsafe to continue work.
9.3 Refunds: Refunds, if applicable, will be calculated based on work completed and costs incurred. Deposits are non-refundable once materials have been ordered or work has begun.
10.1 Permit Responsibility: We will obtain necessary permits for the work as required by local building codes. Permit costs are typically included in the project quote or billed separately as specified in the contract.
10.2 Code Compliance: All work is performed in accordance with applicable building codes and regulations. If existing conditions are found to be non-compliant, additional work may be required to bring the project up to code.
10.3 Inspections: Required inspections will be scheduled and coordinated. Clients must provide access for inspectors. Failed inspections due to pre-existing conditions may result in additional costs.
11.1 Informal Resolution: We encourage clients to communicate any concerns directly with us. Most issues can be resolved through open communication and good-faith negotiation.
11.2 Mediation: If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing legal action. Mediation costs will be shared equally.
11.3 Governing Law: These Terms are governed by the laws of the State of Ohio. Any legal action must be brought in the courts of Franklin County, Ohio.
